5 Driving Laws in Georgia That May Surprise You

Free Consultation

Most drivers in Georgia know the basics, such as wearing a seat belt and obeying the speed limit. However, there are some state traffic laws that experienced drivers may be unaware of. Violating one of these laws can result in a ticket and could also affect your ability to recover compensation through a personal injury claim if you are involved in a car accident.

Here are five Georgia driving laws that tend to catch people off guard.

1. The Slow Poke Law

Georgia’s “slow poke law” generally prohibits a driver from remaining in the far-left passing lane when the driver knows or should know a faster vehicle is overtaking from the rear, subject to several exceptions. It doesn’t matter if you’re going the speed limit. If you’re in the left lane and not overtaking someone, you can be pulled over and cited.

This law was designed to reduce traffic congestion and road rage incidents caused by slower drivers blocking the passing lane. A violation can result in a fine as well as points on your license. In the context of an accident, driving slowly in the left lane and forcing other vehicles to pass on the right could constitute negligence.

2. The Move Over Law

Georgia requires drivers to move over one full lane when approaching a stopped emergency or utility vehicle with flashing lights on the side of the road. If changing lanes isn’t possible due to traffic, you must slow down below the posted speed limit and be prepared to stop.

This law was expanded in recent years to include more types of vehicles beyond just police cars and ambulances. Violating it can result in a fine of up to $500 in addition to possible criminal penalties and civil liability in the event of a crash.

3. Headlight Requirements in the Rain

Many drivers don’t realize that Georgia law requires you to turn on your headlights in the rain. It doesn’t matter if it’s the middle of the afternoon and visibility seems fine; when it’s raining, your headlights need to be on.

The reasoning is straightforward. Rain reduces visibility for everyone on the road, and headlights also make your vehicle easier to spot. Driving without headlights in the rain is a citable offense and could be used as evidence of liability if you’re involved in an accident during wet conditions.

4. Right on Red Isn’t Always Allowed

Turning right on a red light is legal in Georgia under most circumstances, but not all. If a sign at the intersection specifically prohibits right turns on red, you must wait for a green signal. Ignoring that sign is a traffic violation.

In situations where making a right on red is permitted, drivers are still required to come to a full stop first and yield to pedestrians and oncoming traffic before proceeding. Rolling through a red light without stopping is one of the more common causes of intersection accidents in the state.

5. Open Container Laws Apply to Passengers

Georgia’s open container law prohibits any person in the passenger area from consuming alcohol or possessing an open alcoholic beverage container. The only exception is for passengers in the rear of certain commercial vehicles like limousines and party buses.

Breaking any of these laws can do more than just earn you a fine. If a violation contributes to an accident, it can be used as evidence against you in a personal injury case. On the other hand, if the other driver was the one who broke the law, that fact can strengthen your claim significantly.
